根據(jù)第十屆全國(guó)人民代表大會(huì)第一次會(huì)議通過(guò)的《關(guān)于國(guó)務(wù)院機(jī)構(gòu)改革方案的決定》，國(guó)務(wù)院決定設(shè)立中國(guó)銀行業(yè)監(jiān)督管理委員會(huì)（簡(jiǎn)稱中國(guó)銀監(jiān)會(huì)）。中國(guó)銀行業(yè)監(jiān)督管理委員會(huì)根據(jù)第十屆全國(guó)人大常委會(huì)第二次會(huì)議通過(guò)的《關(guān)于中國(guó)銀行業(yè)監(jiān)督管理委員會(huì)履行原由中國(guó)人民銀行履行的監(jiān)督管理職責(zé)的決定》，統(tǒng)一監(jiān)督管理銀行、金融資產(chǎn)管理公司、信托投資公司及其他存款類金融機(jī)構(gòu)，維護(hù)銀行業(yè)的合法、穩(wěn)健運(yùn)行。中國(guó)銀行業(yè)監(jiān)督管理委員會(huì)自2003年4月28日起正式履行職責(zé)?，F(xiàn)就有關(guān)事項(xiàng)公告如下：

　　一、銀監(jiān)會(huì)的主要職責(zé)

　　制定有關(guān)銀行業(yè)金融機(jī)構(gòu)監(jiān)管的規(guī)章制度和辦法；審批銀行業(yè)金融機(jī)構(gòu)及分支機(jī)構(gòu)的設(shè)立、變更、終止及其業(yè)務(wù)范圍；對(duì)銀行業(yè)金融機(jī)構(gòu)實(shí)行現(xiàn)場(chǎng)和非現(xiàn)場(chǎng)監(jiān)管，依法對(duì)違法違規(guī)行為進(jìn)行查處；審查銀行業(yè)金融機(jī)構(gòu)高級(jí)管理人員任職資格；負(fù)責(zé)統(tǒng)一編制全國(guó)銀行數(shù)據(jù)、報(bào)表，并按照國(guó)家有關(guān)規(guī)定予以公布；會(huì)同有關(guān)部門提出存款類金融機(jī)構(gòu)緊急風(fēng)險(xiǎn)處置的意見和建議；負(fù)責(zé)國(guó)有重點(diǎn)銀行業(yè)金融機(jī)構(gòu)監(jiān)事會(huì)的日常管理工作；承辦國(guó)務(wù)院交辦的其他事項(xiàng)。

　　ANNOUNCEMENT CHINA BANKING REGULATORY COMMISSION Number 1， 2003

　　April 28， 2003

　　Pursuant to the Decision on Institutional Restructuring of the Government Agencies under the State Council adopted by the First Session of the Tenth National People‘s Congress， the State Council has decided to establish the China Banking Regulatory Commission （CBRC）。 Further， pursuant to the Decision on the Exercise of Regulatory and Supervisory Functions by the China Banking Regulatory Commission in Place of the People’s Bank of China adopted at the Second Session of the Standing Committee of the Tenth National People‘s Congress， the CBRC is responsible for the regulation and supervision of banks， asset management companies， trust and investment companies as well as other deposit-taking financial institutions. Its mission is to maintain a safe and sound banking system in China. The CBRC will officially start functioning on April 28， 2003.

　　I.　The CBRC‘s major responsibilities

　　Formulate supervisory rules and regulations for banking institutions；

　　Authorize the establishment， changes， termination， branching and business scope of banking institutions；

　　Conduct fit and proper tests for directors and senior managers；

　　Conduct off-site surveillance and on-site examinations of banking institutions；

　　Investigate， penalize and take enforcement actions on activities that violate relevant laws and regulations；

　　Compile and publish statistics and reports of the overall banking sector in accordance with relevant laws and regulations；

　　Make proposals on the resolution of problem deposit-taking institutions in consultation with relevant authorities；

　　Be responsible for the administration of the supervisory boards of the state-owned financial institutions； and

　　Perform other responsibilities delegated by the State Council.
