合作建房是指一方提供土地使用權(quán),另一方或多方提供合作房地產(chǎn)開(kāi)發(fā)資金的房地產(chǎn)開(kāi)發(fā)形式。合作建設(shè)涉及多方利益。為防止今后發(fā)生糾紛,在確定合作建房時(shí),應(yīng)及時(shí)簽訂書(shū)面的《合作建房合同》。我們應(yīng)該如何簽訂合作建筑合同?詳情請(qǐng)參閱下文。(uuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUU電話:UUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUUU授權(quán)代表:標(biāo)題:根據(jù)《中華人民共和國(guó)城市房地產(chǎn)管理法》和其他相關(guān)法律法規(guī)的規(guī)定,第一條序言基于:1。甲方已依法通過(guò)招標(biāo)(或拍賣或行政劃撥)方式取得該地塊的土地使用權(quán),該地塊的規(guī)劃用途為:容積率為:規(guī)劃建筑面積為:平方米,土地使用權(quán)期限自年月日至年月日土地使用權(quán)證書(shū)(或土地使用紅線圖)編號(hào)為:;2.乙方是經(jīng)主管部門(mén)批準(zhǔn)取得房地產(chǎn)開(kāi)發(fā)企業(yè)資格的具有獨(dú)立法人資格的房地產(chǎn)開(kāi)發(fā)企業(yè);甲乙雙方在平等自愿、協(xié)商一致的基礎(chǔ)上簽訂本合作建房合同。第二條合作建房,甲方同意根據(jù)現(xiàn)狀提供上述第一條所述地塊的土地使用權(quán),乙方同意根據(jù)本合同第三條提供建設(shè)資金,由雙方合作建房辦公樓開(kāi)發(fā)完成(或商業(yè)、住宅和住宅)第一層房屋按本合同第六條劃分產(chǎn)權(quán)。第三條房屋建設(shè)資金預(yù)計(jì)為人民幣元,全部由乙方提供,實(shí)際建設(shè)成本高于或低于預(yù)計(jì)金額的部分由乙方承擔(dān)和享有建設(shè)資金是指自本合同生效之日起至房屋驗(yàn)收合格、甲方取得房地產(chǎn)證時(shí)所需的一切費(fèi)用和支出。建設(shè)資金不包括甲方為通過(guò)招標(biāo)、拍賣取得土地使用權(quán)而應(yīng)支付的土地使用費(fèi),也不包括甲方為取得土地使用權(quán)而應(yīng)支付的地價(jià)第四條除按規(guī)定由雙方共同辦理審批手續(xù)外,乙方應(yīng)負(fù)責(zé)包括本合同在內(nèi)的所有審批手續(xù),但甲方有義務(wù)協(xié)助乙方辦理審批手續(xù),包括提供所需資料第五條甲方負(fù)責(zé)設(shè)計(jì)、建筑工程設(shè)計(jì)和施工的招標(biāo)和施工監(jiān)理,但根據(jù)本合同第條規(guī)定應(yīng)向甲方分配產(chǎn)權(quán)的設(shè)計(jì)圖紙應(yīng)提交審批并實(shí)施工程設(shè)計(jì)招標(biāo)應(yīng)在合同生效后的第三天進(jìn)行,整個(gè)施工工程應(yīng)在合同生效后的天內(nèi)完成,在天內(nèi)開(kāi)工,在第二天內(nèi)完成竣工驗(yàn)收第六條所有建筑物的產(chǎn)權(quán)由甲、乙雙方按以下方式或比例分享:甲、乙雙方共有一層房屋的產(chǎn)權(quán)為乙方共有,房屋產(chǎn)權(quán)為乙方共有工程竣工驗(yàn)收-甲方應(yīng)在天內(nèi)辦妥手續(xù),取得該房屋產(chǎn)權(quán)部分的房地產(chǎn)證書(shū)。第七條違約責(zé)任1.乙方未在本合同第五條第二款約定的時(shí)間內(nèi)完成工程設(shè)計(jì)招標(biāo)的,或天內(nèi)開(kāi)工,或天內(nèi)竣工驗(yàn)收在個(gè)月內(nèi)完成的,甲方有權(quán)終止合同并要求乙方賠償損失。2.除甲方造成的延誤外,如果乙方未能在第2款約定的時(shí)間內(nèi)完成房地產(chǎn)證書(shū)第六條乙方應(yīng)按照主管部門(mén)下達(dá)的租金指導(dǎo)價(jià)向甲方支付違約金。3.因甲方原因?qū)е聢?bào)批或項(xiàng)目延誤的,延誤時(shí)間為個(gè)月內(nèi),乙方有權(quán)要求甲方按規(guī)定向乙方支付違約金主管部門(mén)出具的指導(dǎo)租金價(jià)格;延誤超過(guò)三個(gè)月時(shí),乙方有權(quán)終止合同,并向甲方索賠。第八條爭(zhēng)議解決因本合同引起的或與本合同有關(guān)的任何爭(zhēng)議,均應(yīng)提交中國(guó)國(guó)際經(jīng)濟(jì)合作組織分委會(huì)mic和貿(mào)易仲裁委員會(huì)根據(jù)申請(qǐng)仲裁時(shí)該委員會(huì)執(zhí)行的仲裁規(guī)則進(jìn)行仲裁。仲裁裁決是終局的,對(duì)雙方均有約束力。第9條本合同經(jīng)政府主管部門(mén)批準(zhǔn)后生效。甲方:_______________________授權(quán)代表(簽字):乙方:授權(quán)代表(簽字)地址:日期:合作建房前簽訂的合作建房合同有助于防止未來(lái)的糾紛,也為相關(guān)糾紛提供了解決辦法。對(duì)于所有參與合作建房的各方而言,合作建房合同都是合作建房合同為了保護(hù)他們的合法權(quán)益。閱讀后有什么問(wèn)題嗎?luba.com律師在線為您解答
